Editorial framework — pending lawyer review

This document is an editorial framework drafted for GA Flight's transparency needs. It must be reviewed and validated by a lawyer specialised in digital law before any commercial use. Values in square brackets [...] are to be completed by the editor after company registration.

1. Purpose

These terms (hereafter "the Terms") define the conditions under which GA Flight (hereafter "GA Flight") provides the online service accessible via the domains gaflight.com, console.gaflight.com and api.gaflight.com (hereafter "the Service") to any registered legal entity or natural person (hereafter "the Customer").

2. Service access

  • Free trial: GA Flight offers a 14-day free trial without commitment. No credit card is required during the trial if the "Pilot Solo" (free) option is chosen.
  • Registration: registration requires accurate information (name, professional email, organisation). The Customer warrants the accuracy and currency of this data.
  • Credentials: each user is responsible for the confidentiality of their credentials. Any action performed from an account is deemed performed by its holder.

3. Pricing and billing

Current subscriptions and prices are published on the Pricing page. Prices are quoted in euros, excluding tax. French VAT at the prevailing rate is added for Customers established in France.

  • Billing: paid subscriptions are billed monthly or annually at the Customer's choice, in advance, by Stripe direct debit. An invoice is issued for each period, in compliance with French Tax Code article 289 and Commercial Code article L441-9.
  • Price changes: GA Flight may modify its pricing with 30 days' notice to the Customer. The Customer may terminate without charge before the next billing date if they reject the new pricing.

4. Duration and termination

  • Term: subscriptions are entered into for the period subscribed (monthly or annual), tacitly renewed at each billing date unless terminated.
  • Termination: the Customer may terminate at any time from the subscription management interface. Termination takes effect at the end of the current period. No prorated refund is due for the period in progress, except as required by mandatory law.
  • Termination for breach: GA Flight may suspend or terminate access in case of serious breach of these Terms, after formal notice unanswered for 15 days, except in case of urgency (impact on Service security or third-party rights).

5. Customer data

  • Ownership: the Customer retains full ownership of data entered into the Service (students, flights, instructors, invoices, etc.). GA Flight has only the rights strictly necessary to perform the Service.
  • Portability: the Customer can export their data at any time via the export functions provided by the Service (CSV, FEC, JSON, ICS) at no additional cost.
  • Deletion on termination: except for legal retention obligations (notably accounting, 10 years), data is deleted no later than 30 days after termination. The Customer is invited to export their data before this deadline.

6. Customer obligations

The Customer agrees to use the Service in compliance with applicable laws, including those relating to civil aviation, personal data protection, and taxation.

The Customer refrains from any misuse of the Service (undocumented automated injection, rate limit circumvention, unauthorised access to other accounts, mass data extraction attempts).

The Customer is solely responsible for content they publish or have published on the Service by their users (students, instructors, etc.).

7. Liability

  • Best-effort obligation: GA Flight commits to providing the Service at a quality level consistent with the state of the art, without subscribing to a results obligation. Target availability is 99% on a monthly basis, excluding planned maintenance and force majeure.
  • No regulatory warranty: the Service is a management tool. It is not, in itself, a regulatory approval. The Customer remains responsible for complying with their obligations to the DGAC, EASA, or any other competent authority.
  • Cap: subject to mandatory provisions, GA Flight's total liability towards the Customer under these Terms is limited to the amounts paid by the Customer in the 12 months preceding the triggering event.
  • Force majeure: neither party may be held liable for a breach resulting from a force majeure event within the meaning of French Civil Code article 1218.

8. Service intellectual property

The Service, its source code, documentation, trademarks, and design are the exclusive property of GA Flight. The Customer benefits from a personal, non-exclusive and non-transferable right of use during their subscription.

9. Sub-processors and personal data

The processing of personal data by GA Flight, as data processor or controller depending on the case, is governed by the privacy policy and the Data Processing Agreement (DPA) which the Customer can request at any time via support@gaflight.com.

10. Modifications

GA Flight may modify these Terms at any time. Any substantial modification is notified to the Customer by email or via the interface at least 30 days before its entry into force. The Customer may terminate without charge if they reject the modification.

11. Applicable law and jurisdiction

These Terms are governed by French law. Any dispute relating to their formation, interpretation, or execution shall be submitted, failing amicable resolution, to the exclusive jurisdiction of the French courts of GA Flight's registered office, except for mandatory contrary provisions.
